Court endorses Mohammed Imam is PDP candidate

A federal high court sitting in Maiduguri has rulled in favour of Mohammed Imam ordering the Independent National Electoral Commission (INEC) to recognise him as the legally selected candidate of the Borno PDP for the 2019 gubernatorial election.


This was after Justice Jude Dagat dismissed the submissions of the Usman Mahdi faction candidate, Mohammed Wakili of the party in which he wanted to be recognized as the legal candidate of the party going into the elections of lacking in merits and been a purely preelection matter of the party that was carried out in accordance with the provisions of the party constitution as contained in INEC's electoral act.

 
After hearing submissions from both factions of the party, Justice Dagat stated in his ruling that the Usman Mahdi faction of the PDP could not rely on a court judgment to violate electoral laws. The Judge says all electoral matters of a party are the exclusive affairs of the national body of the party and not of the state executive.
 
 
He said the primaries organized by the faction did not meet the electoral requirements of INEC which states that an election must be conducted and monitored by the national body of the party and INEC respectively which were clearly violated.
 
This judgment is coming just days after the national body of the PDP recognized Usman Mahdi as the legitimate chairman of the party after the same high court recognized him as the duly elected chairman of the party in July.
